These are not necessarily serious enough to warrant a vehicle recall, but are important to know in order to keep your own vehicle in the safest possible condition.

Identity Theft is Increasing

Identity theft has been in the news lately, with incidents ranging from the loss of personal information on millions of U.S. veterans, to the loss of names and Social Security numbers from accounts of more than one million people who had received student loans from the Texas Guaranteed Student Loan Corporation, to the loss of addresses and credit card information on almost 250,000 customers of Hotels.com, to the theft of a laptop computer containing information on hundreds of Social Security disability claimants from a Social Security office in Virginia.

An earlier article from this newsletter about tips to protect yourself from identity theft is worth repeating here.

• Your Social Security number is often the key to identity theft. Never carry your Social Security number in your wallet or checkbook. Don’t even think about having it printed on your checks.

• Guard your Social Security number closely. Do not give it out to anyone unless you are convinced it is necessary for them to have it. This means only give it to governmental agencies or to businesses you absolutely trust. Always ask if a business will accept another means of identification other than your Social Security number.

• Be careful when you dispose of documents that contain sensitive information, such as credit card receipts. Use a shredder if possible. If not, tear the papers carefully to obscure the information.

• Don’t post personal information to the Internet. You can use Internet areas such as genealogical sites or high school reunion sites without revealing too many details.

• Check your credit report at least once each year and correct any errors in writing. You can get a credit report free each year from AnnualCreditReport.com.

• Review all bank statements and credit card statements carefully so you can discover quickly whether someone else is using your bank account or credit cards.

If you should discover that someone is using your identity, here are some steps you should take:

• Report it immediately to credit agencies and to the police.

• Monitor your financial and credit card statements for any unusual purchases.

• Close banking or credit card accounts you believe may have been affected.

• File a complaint with the Federal Trade Commission. The FTC's identity theft Web site is www.consumer.gov/idtheft.

• Contact the fraud department of any of the major credit bureaus and have them place a fraud alert on your credit file. Whichever credit bureau you call will pass along your alert to the other two bureaus. The credit-reporting agencies are:

Equifax: 1-800-525-6285 or 1-888-766-0008.
Experian: 1-888-397-3742.
TransUnion: 1-800-680-7289.

Census Bureau Report -- Disabled People Earn Less 

A new report from the U.S. Census Bureau shows that disabled Americans fare worse than the able-bodied in many aspects of life.

For instance, the 18.1% of the population with a disability were three times as likely to live in poverty as the rest of the population. Median annual earnings for people with no disability were $25,000, in comparison with $22,000 for people with a non-severe disability, and $12,800 for those with a severe disability.

Disabled people are also not as well educated as others. For people with a severe disability, the high school dropout rate is 18.7%, compared with a dropout rate of 10.4% for non-disabled individuals.

This census bureau report is somewhat at odds with the information provided by the Social Security Administration when it recently proposed new regulations raising the age requirements for Social Security disability claimants to successfully receive certain benefits. The Social Security Administration indicated at the time that raising the age limits merely reflected real life changes in the ability of disabled people to find and keep employment.

Our law firm was recently successful in helping to obtain Supplemental Security Income (SSI) benefits for a client, but we had to go to federal court to win the case.

Our client's claim was denied by an Administrative Law Judge, and her request for the Appeals Council to review the Judge’s decision was denied as well. Therefore, we filed a civil action in the United States District Court for the Northern District of Texas. The court remanded the case to the Commissioner of Social Security for further proceedings. When all was said and done the claim went back before the Administrative Law Judge and the Judge once again denied the claim.

Demonstrating zealous advocacy for our client, our law firm filed a second appeal brief with the Appeals Council. Persistence paid off as this time the Appeals Council rendered a fully favorable decision for our client. She was found to have been disabled since April 11, 2001, and will likely be entitled to a substantial amount of past due benefits.

We congratulate our client, and we are grateful that her long wait for benefits has ended. Her case illustrates that persistence can pay off, and that our firm will diligently fight to secure Social Security disability benefits for our disabled clients.
