Brain Injury Association of Texas and the Coalition of Texans With Disabilities

Attorney Joseph R. Morrison of our firm recently attended a joint convention of the Brain Injury Association of Texas (BIATX) and the Coalition of Texans with Disabilities (CTD) in Austin, Texas. The BIATX is a non-profit public service organization dedicated to providing emotional support, advice, guidance, and other help to brain injury victims and their families. The CTD is a cross-disability organization that advocates for the rights of Texans with disabilities. Our law firm supports the work of each of these fine organizations and appreciates the assistance they provide to disabled Texans.

The CTD, for example, successfully advocated for the rededication of hundreds of millions of dollars in funding to community services for Texans with disabilities during the 78th legislative session in 2001. The CTD was also instrumental in restoring a 15% cut in home-based attendant care for people with disabilities.

Mr. Morrison enjoyed a session entitled "Critical Bills for Texans with Disabilities" featuring a panel of disability advocates. The panel did an excellent job of identifying current legislation impacting Texans with disabilities, and counseled attendees on the need to raise their voice. For example, as of this time the Senate has approved less than half of the funds requested by the Health and Human Services Executive Commissioner to reduce the waiting list for community-based services. More than 80,000 disabled Texans remain on waiting lists for community-based services.

Mr. Jonas Schwartz gave a presentation entitled "How Do I Work and Not Lose My Social Security Benefits - Medicaid Buy-In." If you are a former Social Security disability client and plan on attempting a return to work, please feel free to contact our law firm if you have any questions about this.

Mr. Morrison also learned more about a resolution that should be supported by current as well as former Social Security Disability clients. House Concurrent Resolution 35 is a proposed bill that urges the U.S. Congress to enact legislation to eliminate the 24-month Medicare waiting period for participants in Social Security Disability Insurance (SSDI). As many former clients are aware, SSDI is for people who have worked and paid into the system. People who have worked and paid into the system should not be required to wait 24 months to be eligible to receive the medical care they desperately need. During the 24-month waiting period, many disabled Texans without insurance will incur significant medical expenses or forgo necessary treatment, in which case their conditions will likely deteriorate. All Texans should support House Concurrent Resolution 35.

We strongly encourage our disabled clients to become active members of one of these wonderful organizations. Both of these groups will help you to get your voice heard and advocate passionately on your behalf. An individual membership to the CTD is only $25 per year. Veterans Will Soon Have Access to Lawyers in Disability Claims

Legislation recently enacted by Congress will allow veterans to hire attorneys to assist them in claims for disability benefits before the Department of Veterans Affairs. Before this legislation was passed, veterans were virtually denied the right to hire an attorney to represent them before the VA regional offices (ROs) or the Board of Veterans’ Appeals (BVA). Essentially, veterans were not allowed to hire an attorney to assist them at the first two levels of the three-tiered VA claims process.

Thanks to the newly passed legislation, however, a veteran's fundamental right to legal representation has been greatly restored. Under the new law a veteran is free to hire an attorney to assist the veteran in a claim for benefits before the Department of Veterans Affairs after a Notice of Disagreement (NOD) has been filed. The filing of a NOD is the initial step in the appeal process after a veteran receives an adverse RO decision, denying a claim in whole or in part.

Attorney Joseph Morrison was quoted in the May 2007 edition of the Journal of the American Bar Association in an article addressing the recent legislation and the effect attorney representation will have on the VA claims process. He specifically addressed the need for attorneys to assist Veterans Service Organizations. The article states:

"These veterans service organizations do a great job, especially here in Texas. We've got a strong network," Morrison says. "We just want to work beside them, to really complement the work they're doing, in no way supplanting them."

In Guilty Plea, OxyContin Maker to Pay $600 Million

Our law firm represents many people who have been the victims of prescription drug injuries. So it gave us some satisfaction when executives of one of the really bad drug companies had to plead guilty to lying to the Food and Drug Administration.

Three executives of Purdue Pharma, the company that makes the narcotic painkiller OxyContin, pleaded guilty this month in federal court to criminal charges that they misled regulators, doctors, and patients about the drug’s risk of addiction and its potential to be abused. Also, in a rare move, three executives of Purdue Pharma, including its president and its top lawyer, pleaded guilty as individuals to misbranding, a criminal violation. They agreed to pay a total of $34.5 million in fines.

OxyContin is a powerful, long-acting narcotic that provides relief of serious pain for up to 12 hours. Initially, Purdue Pharma contended that OxyContin, because of its time-release formulation, posed a lower threat of abuse and addiction to patients than do traditional, shorter-acting painkillers like Percocet or Vicodin.

Federal officials said that internal Purdue Pharma documents show that company officials recognized even before the drug was marketed that they would face stiff resistance from doctors who were concerned about the potential of a high-powered narcotic like OxyContin to be abused by patients or cause addiction. As a result, company officials developed a fraudulent marketing campaign designed to promote OxyContin as a time-released drug that was less prone to such problems.
