It is very important that you are aware of critical deadlines mandated by the nationwide class action settlement agreement that affect your legal rights to be in or out of the nationwide settlement, should you wish to pursue this matter now or in the future. By our calculations any diet drug recipient who wishes to preserve all of their rights afforded under the national class action settlement must receive a diagnosis from a qualified physician as defined in the nationwide class action settlement agreement by January 3, 2003, and must register with the American Home Products Trust by May 3, 2003. To obtain a diagnosis, you must obtain an approved echocardiogram by January 3, 2003, and must promptly mail a Gray Form to the AHP Trust to document any qualifying condition, consisting of mild or greater mitral or aortic valve regurgitation. To register with the AHP Trust, you must file a Blue Form with the AHP Trust by May 3, 2003.
Failure to obtain an approved echocardiogram by January 3, 2003, and promptly mailing a Gray Form to the AHP Trust and/or the failure to register with the AHP Trust by filing a Blue Form, may prevent you from receiving current or future compensation and may forever bar your rights to make an intermediate opt-out or backend opt-out election. Although we have highlighted two important deadlines, this is not an exhaustive list of deadlines that may affect your legal rights. You should obtain a detailed timeline from the AHP Trust for your further review and consideration.
